During a Divorce process in Cyprus the Family Courts are able to grant exclusive use of the home or matrimonial possessions but absolute settlements of matters concerning property disputes need to be dealt with by means of separate applications.
In Cyprus, the Law Regulating Property Relations of Spouses (Law 232,1991) provides the settlement provisions after breakdown. The main provisions of the law are:
- In the event of dissolution or annulment of a marriage and in the event that the property of one spouse has been increased during the wedding and this increase has been contributed to in any way the other spouse then the contribution is presumed to be 1/3 of the increase, unless a larger or smaller contribution may be proved.
- the financially stronger spouse may be ordered for maintenance of the other spouse depending to the other spouse's employment (if any), age and medical needs as well as to children's needs. The amount of maintenance will depend to the financial strength of the stronger spouse as well as on the needs of the other spouse and their Child or Children, if any.
