Краткий обзор соответствующего законодательства Республики Кипр
«Похищение ребенка», согласно закону о защите прав и интересов детей, означает вывоз или удержание ребенка за границей одним из родителей без согласия второго родителя. К примеру, если родители, находящиеся в разводе, проживают на Кипре, и мать увозит ребенка или детей в Великобританию без согласия отца, такие действия могут рассматриваться как похищение, даже если у матери есть постановление суда об опеке (такое правило не распространяется на поездки на отдых).
Международный обзор
Гаагская конвенция 1980 года о гражданско-правовых аспектах международного похищения детей, принятая 90 странами, в том числе Кипром, гарантирует немедленное возвращение детей, которые были похищены из страны их постоянного проживания. Другими словами, документ определяет, что ребенок должен вернуться в страну, где проживал до похищения. Более того, ЕС предусматривает правовое регулирование ситуаций с похищением детей, а также правила рассмотрения судами таких дел.
