EU Trademarks

According to the provisions of the Community Trade Mark (CTM) Regulations, any trade mark registered with the Office of the Harmonization of the Internal Market (OHIM) is valid and binding across all EU member states.

What is the EU trademark scope?

A European trademark registration (CTM) grants you (i.e. the owner) with an exclusive right to prohibit unauthorized use of the mark without your consent, in any EU member state.  You may further prevent a third party from using a similar mark to your trademark which may create confusion to the ownership or identity of either the products or the services that you have registered the trademark for.

What is the duration of validity of an EU trademark?

An EU trademark registration is valid for a period of 10 years from the day of filing the application.  Upon the expiration of the 10 years you may renew the trademark for indefinite periods of 10 years thereafter.

What is the process for registering an EU trademark?

An EU trademark may be registered through a single application process. The application is being examined by a single administrative center and a successful trademark application is registered within a period of up to 6 months.

The application must state the classes (45 in total) which the trademark intents to cover. You should note that the cost of an EU trademark registration will very much depend to the number of classes which will it cover; the more classes the higher the cost.  Therefore, an initial advise on what classes should sufficiently cover your product or services is deemed vital.
