Медицинский несчастный случай не обязательно означает врачебную ошибку. Неудачное лечение не всегда связано с врачебной ошибкой. При применении лечения всегда есть риск негативных последствий, о чем необходимо предупреждать пациентов.
Закон Республики Кипр о небрежности/халатности основан на общем английском праве и предоставляет право на компенсацию в случае, когда пострадавший может доказать причинение вреда вследствие ненадлежащего лечения. То есть необходимо доказать, что лечение, которое вы получили, не соответствовало принятым стандартам лечения, применяемого в подобных случаях.
Врачебная халатность
Случаи врачебной халатности активно оспариваются. Это крайне специфическая сфера, требующая наличия у адвоката должного опыта.

Законодательство
Закон о врачебной халатности Республики Кипр основан на общем английском праве. Истец/пациент в деле о медицинской халатности должен доказать, что «с учетом всех факторов» доктор проявил халатность (действия или бездействие). Стандартный тест в таких случаях — ответ на вопрос, каких действий разумно было бы ожидать от врача в конкретных обстоятельствах.
Важно помнить, что в делах о медицинской халатности необходимо не только доказать факт халатности со стороны доктора, но и установить причинно-следственную связь между фактом халатности и причинением вреда здоровью. Часто доктора в свою защиту утверждают, что травма произошла вследствие других обстоятельств, а не в результате лечения. В таких случаях необходимо привлекать другого медицинского специалиста для защиты позиции пострадавшего.
